Overview

The following terms of use agreement (this “Agreement”) between you and Hunter Sales i Stockholm AB. (“Hunter”) governs your access and use of this Nordic Hunter application (“Nordic Hunter Application”). By accessing, browsing, or using Nordic Hunter Application, you acknowledge that you have read, understood, accept and agree to be bound by this Agreement and to comply with all applicable laws and regulations, including export and re-export control laws and regulations. If you do not agree to this Agreement, please do not use Nordic Hunter Application. Hunter reserves the right to update this Agreement and any other information contained in Nordic Hunter Application at any time without notice to you. By using Nordic Hunter Application, you agree to be bound by the terms and conditions of this Agreement that is in force during such use. You can always review the most current version by clicking on the “Legal Terms” link located at the bottom of our Web pages.

Hunter provides the following services for use in conjunction with various Hunter Internet-connected products (“Products”): (1) the Nordic Hunter Application; (2) a Nordic Hunter user website and user accounts that may be accessed at www.hunterworld.se, and all associated sites connected with www.hunterworld.se (the “Website”); (3) online services accessible through the Website (“Web Apps”); (4) software applications that can be downloaded to a mobile device (“Mobile Apps”); and (5) subscription services, including paid subscriptions to the cloud storage services maid available by Hunter and other paid features (“Subscription Services”). The term “Hunter World Services” means the Nordic Hunter Application, Website, Web Apps, Mobile Apps, and Subscription Services. Your use of Nordic Hunter and of any Hunter World Services, including updates, enhancements, new features, and changes, are subject to this Agreement.

These Terms of Use (“Terms”) govern your access to and use of the Hunter World Services, including through the Products. Your purchase of any Hunter World Service or Product is governed by the Hunter World Terms and Conditions of Sale, along with any limited warranty provided with it. The Privacy Policy is incorporated by reference into these Terms and you are agreeing to accept and abide by them by using any Hunter World Service. PLEASE READ THESE TERMS CAREFULLY. If you do not agree with these terms, do not access, use, or register for any Hunter World Service.

1. No Life-Safety or Critical Uses of the Hunter World Services

You acknowledge and agree that the Hunter World Services and Products are not certified for emergency response. Hunter makes no warranty or representation that use of the Hunter World Services or Products with any third-party product or service will affect or increase any level of safety or security. The Hunter World Services and Products are not third-party monitored emergency notification system — Hunter will not dispatch emergency authorities to your home in the event of an emergency. All life threatening and emergency events should be directed to appropriate response services.

2. Limitation to personal and non-commercial use

The content of Hunter World Services is protected by law, including without limitation copyright law, trademark law, and applicable international treaties. Hunter World Services, including all content in the Nordic Hunter Application are provided for your personal and non-commercial use. You may not “mirror” any content contained within Nordic Hunter. You may not, in any form by any means, modify, copy, distribute or otherwise disclose or disseminate, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from Nordic Hunter or Hunter World Services without Hunter’s prior written consent. Permission to use Nordic Hunter and Hunter World Services is conditioned on your not modifying the content displayed on this site or contained in Hunter World Services, your keeping intact (and following) all copyright, trademark, and other proprietary notices, and your acceptance of this Agreement as well as any terms, conditions, and notices accompanying the content or otherwise set forth in this site. Notwithstanding the foregoing, any software and other materials that are made available for downloading, access, or other use from this site with their own license terms, conditions, and notices will be governed by such terms, conditions, and notices. Your failure to comply with the terms, conditions, and notices on this site will result in automatic termination of any rights granted to you, without prior notice, and you must immediately destroy all copies of downloaded materials in your possession or control. Except for the limited permission in the preceding paragraph, Hunter does not grant you any express or implied rights or licenses under any patents, trademarks, copyrights, or other proprietary or intellectual property rights of Hunter or its licensors except as expressly stated in this Agreement.

3. Electronic Contracting and Messaging

By using the Hunter World Services, registering the Product, creating an online account for the Hunter World Services (“Account”), or engaging in any transactions via the Hunter World Services, you are agreeing to these Terms and our Privacy Statement. You agree that when you use your login credentials or click on any “I Agree” button when using the Hunter World Services, you affirmatively consent to conduct business electronically with Hunter, and such credentials and processes have the same force and effect as your written signature. You agree and consent to Hunter sending you disclosures, messages, notices, and other communications, including direct marketing text messages, to your designated mobile phone and email account.

4. These Terms May Change

Hunter reserves the right to make changes to these Terms over time at any time without notice to you. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you. Continued use of any Hunter World Service following such change will indicate your acknowledgment and agreement to be bound by the revised Terms.

5. Relationship to Product Warranty

These Terms govern your use of the Hunter World Services. Your purchase of any Product is governed by the limited warranty provided with that Product.

6. Eligibility; Children

You are prohibited from registering a Product for use with the Hunter World Services or from using the Hunter World Services unless you are 18 years of age or older. You may not use the Hunter World Services where prohibited by applicable law. We also do not knowingly collect any information from children under the age of 16 Any use or access to the Hunter World Services by individuals under the age of 15 is strictly prohibited and is a violation of these Terms. If you are between the ages of 16 and 18 years of age, you must have your parent or legal guardian register a Product or create an Account to use the Hunter World Services, and you must only use the Hunter World Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Please contact us at support@hunterworld.se if you believe we might have any information from or about a child under 16, or if we might have any information from or about a child without verification of parental consent, and we will delete that information.

7. Rules re. video surveillance – Your responsibility

You are responsible for Your use of a trail camera equipment and the compliance with any and all applicable rules in connection with such use. Hunter disclaims all warranties, representations, and liabilities in connection Your use of a trail camera not in compliance with the Swedish Hunting Statutes, the Hunting Regulations, the Camera Surveillance Act, the GDPR or any other applicable law and shall not be liable for damages of any kind related to Your use of a a trail camera.

8. Creating an Account

To use your Product via Hunter World Services, you are required to create an Account. You represent and warrant that: (i) all required registration information you submit is truthful, accurate and complete; (ii) you will maintain the accuracy, security, and confidentiality of such information; and (iii) your use of the Hunter World Services does not violate any applicable law or regulation. You have no right to transfer your Account to any other individual in any manner, which includes sharing your password with other individuals. Hunter is not liable for any loss or damages arising from your failure to maintain the confidentiality of your Account. You agree to notify Hunter immediately of any unauthorized access to or use of your Account or any breach of security.

9. System and Equipment Requirements

Use of certain Products or discrete functionality may require Internet access and registration to the Hunter World Services. You must have the necessary hardware, software, and Internet access needed to register and use the Product with the Hunter World Services. The Hunter World Services may be accessible without: (i) a working Wi-Fi network that is positioned to communicate reliably with our Products; (ii) a computer or a mobile device with Android OS or Apple iOS to pair the Products with its nearby Wi-Fi network; (iii) an Account; (iv) always-on broadband Internet access; and (v) other system elements that may be specified by Hunter in connection with specific Products. In addition, you acknowledge that Hunter may activate Bluetooth or Wi-Fi services on your device, with or without prior notification, in order to facilitate proper registration of the Product, and connectivity and registration to the Hunter World Service.

10. Changes to Hunter World Services

Hunter may change, upgrade, discontinue, or temporarily suspend any feature or component of the Hunter World Services at any time without notice. Hunter cannot guarantee and makes no warranties that any software updates can be implemented on any Product or that changes to the Hunter World Services will operate as intended. You acknowledge that you may be required to install software updates to use the Hunter World Services with your Product, and you agree to promptly install such updates we provide. You are solely liable for any losses arising from a failure to timely implement such updates.

11. License

Subject to your compliance with these Terms, Hunter grants you a revocable, limited, non-exclusive, non-transferable, non-sub-licensable license to install and use (a) Mobile Apps, and (b) any embedded firmware in the Product and updates (“Other Software”), in each case solely in connection with your personal, non-commercial use of the Product and the Hunter World Service. You may only use the Mobile Apps on devices that you own, lease, or otherwise control. No other licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Hunter or its licensors.

12. License Restrictions

Unless as expressly permitted in these Terms, you agree not to, and you will not permit others to, (i) license, sublicense, assign, convey or transfer, the rights and licenses granted hereunder; (ii) publish, display, disclose, sell, rent, lease, store, loan, distribute, transmit, publicly display or perform, co-brand, frame, host, outsource, or otherwise commercially exploit the Hunter World Services, including the Mobile Apps and Other Software (collectively, the “Software”), (iii) copy or reproduce the Hunter World Services or Software or any part thereof, in any form; (iv) remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in the Software or Hunter World Services; (v) use the Software and Hunter World Services in any fashion that may infringe any patent, copyright, trademark, trade secret, or any other intellectual property or proprietary right of Hunter, its third-party providers, or any other third-party; (vi) modify, translate, adapt, disassemble, reverse engineer decompile, reverse compile, or create compilations or derivative works of, the Software, Hunter World Service, or any part thereof (except to the extent applicable laws specifically prohibit such restriction), or (vii) use the Software or Hunter World Services for any service bureau, time-sharing, resale, or similar purposes.

Hunter reserves all rights and licenses in and to the Software not expressly granted to you under these Terms.

13. Access to Hunter World Services

You may only access and use the Hunter World Services solely for the purpose of (a) operating, managing, monitoring, and maintaining the Products, (b) viewing, sharing, and storing video, audio, and other content captured and transmitted by the Products to the Hunter World Services, and (c) to subscribe to the Huntere Services, manage your Account and preferences, and maintain your registration data.

When using the Hunter World Services, you shall not:

• disrupt, interfere with, violate the security of, or attempt to gain unauthorized access to, the Hunter World Services or any computer network;
• circumvent any technological measure implemented by Hunter or any of Hunter’s providers or any other third party (including another user of the Hunter World Services) to protect the Hunter World Services;
• upload, transmit, distribute, or run any computer virus, worm, Trojan horse, or any computer code that could damage or alter a computer, portable device, computer network, communication network, data, the Hunter World Services, or any other system, device, or property;
• run Maillist, Listserv, or any form of auto-responder or “spam” on the Hunter World Services;
• attempt, in any manner, to obtain the password, account, credentials, or other security information from any other user;
• jeopardize the security of your Account or anyone else’s account (for example, by allowing another individual to login into the Hunter World Services as you);
• impersonate any other user, person, or entity (including, without limitation, using e-mail addresses associated with any of the forgoing to create an Account);
• provide referral information for someone else without first obtaining consent from the person being referred and notifying them that they may receive communication from Hunter; or
• violate any applicable federal, state, local, or international law or regulation (including, without limitation, any law regarding the export of data or software to and from the U.S. or other countries).

These Terms shall apply to any future update, release, or other change to the Services.

14. Content

You may elect to display, share, email, or otherwise make available (collectively, “Submit”) text, graphics, photographs, video, images, audio, and other works of authorship via the Product or directly into the Hunter World Services, including for storage and sharing with third parties online (“Your Content”). When you post Your Content in publicly accessible sections of the Hunter World Services or third-party social networking sites via the Hunter World Services, such content will be accessible and viewed by others. You are solely responsible for Your Content submitted through the Hunter World Services, and Hunter will not be liable for any errors or omissions in Your Content.

Hunter may also make available on the Hunter World Services text, graphics, photographs, video, images, illustrations, audio, music, commentary, and other works of authorship it owns or from other users of the Hunter World Services (“Hunter Content”). Hunter Content, along with the Hunter World Service and its underlying technology, are protected by copyright, trademark, patent, intellectual property, and other laws of Sweden and foreign countries. You may access and view Hunter Content solely for personal use and consumption, and are prohibited from copying, selling, renting, distributing (including through digital distribution), publicly performing (including through digital performance), marketing, making derivative works, or otherwise exploiting such Hunter Content without Hunter’s prior written consent.

Hunter makes no endorsement, representation, or warranty of any kind about Your Content or Hunter Content, or any information, services, or recommendations accessed through the Hunter World Services. We are not responsible for the accuracy, reliability, effectiveness, or correct use of information you receive through the Hunter World Service.

You acknowledge and agree that Hunter is solely obliged to save Your Content for a period of seven (7) days from the date of uploading and that Hunter thereafter have the right to delete all Your Content. You therefore agree that You must download any Content You would like to be saved, to your own mobile device.

You agree that all Your Content and Hunter Content accessed by you using the Hunter World Services is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom. You hereby release us from all liability for your having acquired or not acquired Your Content or Hunter Content through the Hunter World Service.

By making Your Content available on or through the Hunter World Services you grant to Hunter a non-exclusive, transferable, sub-licensable, worldwide, royalty-free, perpetual, irrevocable right and license to use, copy, modify, publicly display, publicly perform, and distribute Your Content in connection with operating and providing the Hunter World Services to you. We also have the right to reformat, create derivative works of, excerpt, translate, modify, or otherwise change any of Your Content for storage and viewing via the Hunter World Services. When you post or share Your Content for public viewing, you grant Hunter the right and license to copy, distribute, license, market, perform, display, distribute, exploit, and create derivative works of Your Content without any restriction or compensation to you, in any medium or via any channel now known or later discovered. Such licenses and rights shall be sub-licensable by Hunter.

You represent and warrant that you own Your Content or that you have all rights necessary to Submit Your Content in the manner in which you choose, and that you grant us a license to use Your Content as described in these Terms.

You warrant, represent, and agree that Your Content and the use and provision of Your Content on the Hunter World Services as provided in these Terms will not: (i) infringe, misappropriate, or violate a third party’s patent, copyright, trademark, trade secret, or other intellectual property rights, or rights of publicity or privacy, or other rights; (ii) violate, or encourage any conduct that would violate, any applicable law, statute, regulation, or ordinance, or would give rise to civil liability; (iii) be fraudulent, false, misleading, deceptive, defamatory, tortuous, obscene, harmful, pornographic, vulgar, offensive, or otherwise objectionable; (iv) promote discrimination, racism, hatred, harassment, or harm against any individual or group; (v) be violent, threatening, abusive, or promote violence or actions that are threatening or abusive to any person or entity; or (vi) promote illegal or harmful activities or substances.

All comments, suggestions, feedback, or ideas Submitted by you about the Hunter World Services are Hunter’s property and we may access, copy, modify, redistribute, publish, or otherwise use them for any purpose and in any way without due compensation to you. Hunter does not waive any right to use similar ideas previously known to us or developed by us.

15. Privacy

Please review the Privacy Policy, which describes Hunter’s practices regarding the information that Hunter may collect from users of the Products and Hunter World Services, including Your Content and information provided to us when you create an Account. By accessing and using Hunter World Services, you hereby consent to all actions we may take with respect to your information consistent with our Privacy Policy.

16. Paid Subscriptions

You elect and pay for the level of subscription via the Nordic Hunter Application when downloading the Nordic Hunter Application and thereby subscribe to the online services for Your Content.

17. Third-Party Website Links and Referrals

The Hunter World Services may contain links to other sites operated by third parties (“Third Party Sites”) and referrals to third-party vendors (“Referred Vendors”). Such Third Party Sites and Referred Vendors are not under our control. We provides these links and referrals only as a convenience and we do not review, approve, monitor, endorse, or make any representations or warranties with respect to such Third Party Sites or Referred Vendors for these products and services. We encourage you to review all applicable agreements, terms of use/service, and other policies of these Third Party Sites and Referred Vendors.

18. Release Regarding Third-Parties

Hunter is not responsible for third parties or their products and services, including, without limitation, any third party products and services that enable the Hunter World Services, equipment, ISPs, carriers, the App Stores, Third Party Sites, and Referred Vendors.

19. Limitation of liability

In no event will Hunter be liable to any party for any direct, indirect, incidental, special, exemplary or consequential damages of any type whatsoever related to or arising from Nordic Hunter or any use of (or inability to use) Hunter World Services, or of any site or resource linked to, referenced, or accessed through Hunter World Servicds, or for the use or downloading of, or access to, any materials, information, products, or services, including, without limitation, any lost profits, business interruption, lost savings or loss of programs or other data, even if Hunter is expressly advised of the possibility of such damages. This exclusion and waiver of liability applies to all causes of action, whether based on contract, warranty, tort, or any other legal theories and notwithstanding any failure of essential purpose of any limited remedy.

20. Assignment

You may not assign or transfer these Terms and any associated rights or obligations, by operation of law, without Hunter’s prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. Hunter may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

21. Term and Termination

These Terms will remain in full force and effect as long as you continue to access or use the Hunter World Services, or until terminated in accordance with the provisions of these Terms. At any time, and without prior notice, Hunter may suspend or terminate your rights to use the Hunter World Services if Hunter believes in good faith that you have used a Hunter World Service in violation of these Terms. If you transfer a Hunter Product to a new owner, your right to use the Hunter World Services with respect to that Product automatically terminates, and the new owner will have no right to use the Product or the Hunter World Services under your Account and will need to register for a separate Account with Hunter. Upon termination of your Account, your right to use the Hunter World Services will automatically terminate and Hunter may delete Your Content, unless not already deleted as set out under Section 14 Content, and other information related to your Account at the end of your subscription period. You may cancel your Account at any time by using the cancellation link in the Nordic Hunter Application. Upon your cancellation, all your contact details will be automatically deleted.

22. International use; governing law

Nordic Hunter is controlled and operated by Hunter from Sweden. Hunter makes no representations that materials contained within Nordic Hunter or any Hunter World Services are appropriate or available for use in other locations, and access to Nordic Hunter from locations where such activity is illegal is prohibited. Those who choose to use Nordic Hunter from other locations do so on their own initiative and are solely responsible for compliance with all applicable laws. This Agreement will be interpreted under and governed by the laws of Sweden without regard to its conflict of laws provisions. In any claim or cause of action arising from or related to your use of Hunter’s Web sites or any Hunter World Services, you agree to submit to the personal and exclusive jurisdiction of the ordinary courts of Sweden, with Stockholm District Court (Stockholms tingsrätt) as the first instance.
